La loi n\u00b0\u00a022-23 du 18 d\u00e9cembre 2022 portant statut de l\u2019auto-entrepreneur (ci-apr\u00e8s \u00ab\u00a0loi n\u00b0\u00a022-23\u00a0\u00bb) a pour objet de d\u00e9finir les r\u00e8gles et les conditions applicables \u00e0 l\u2019exercice de l\u2019activit\u00e9 de l\u2019autoentrepreneur<a id=\"bodyftn1\" class=\"footnotecall\" href=\"https:\/\/journals.openedition.org\/rdctss\/5471#ftn1\">1<\/a>. Elle s\u2019inscrit dans la politique alg\u00e9rienne de d\u00e9veloppement de l\u2019entrepreneuriat, destin\u00e9e \u00e0 cr\u00e9er des richesses et \u00e0 encadrer l\u2019\u00e9conomie informelle. Elle int\u00e8gre d\u2019ailleurs un processus de r\u00e9formes d\u00e9j\u00e0 entreprises visant \u00e0 promouvoir la cr\u00e9ation de l\u2019entreprise et \u00e0 stimuler la relance \u00e9conomique. R\u00e9f\u00e9rence est en effet faite \u00e0 la promulgation toute r\u00e9cente d\u2019un d\u00e9cret qui accorde au travailleur la possibilit\u00e9 de b\u00e9n\u00e9ficier d\u2019un cong\u00e9 non r\u00e9mun\u00e9r\u00e9 ou d\u2019un r\u00e9am\u00e9nagement du temps de travail pour pouvoir cr\u00e9er son entreprise<a id=\"bodyftn2\" class=\"footnotecall\" href=\"https:\/\/journals.openedition.org\/rdctss\/5471#ftn2\">2<\/a>, d\u00e9cret suivi d\u2019une loi modifiant la loi de la fonction publique afin d\u2019accorder au fonctionnaire la m\u00eame possibilit\u00e9<a id=\"bodyftn3\" class=\"footnotecall\" href=\"https:\/\/journals.openedition.org\/rdctss\/5471#ftn3\">3<\/a>. Ainsi, pour aller plus loin dans cette voie visant \u00e0 encourager l\u2019initiative priv\u00e9e et l\u2019esprit entrepreneurial, notamment chez les jeunes demandeurs d\u2019emploi, la loi n\u00b0\u00a022-23 offre de nouvelles opportunit\u00e9s d\u2019entrepreneuriat moins contraignantes, et cherche par ailleurs \u00e0 combler le vide juridique en mati\u00e8re de travail ind\u00e9pendant en Alg\u00e9rie.<\/p>\n<\/div>\n<p class=\"texte\"><span class=\"paranumber\">2<\/span>Si le statut de l\u2019auto-entrepreneur en Alg\u00e9rie peut laisser penser qu\u2019il d\u00e9pend des r\u00e8gles issues \u00e0 la fois du droit commercial et du droit du travail, on constate pourtant que la loi de 2022 ne mentionne, ni le Code de commerce, ni le Code du travail. Au contraire, ce texte introduit un cadre juridique original pour le travailleur ind\u00e9pendant, dont la mise en \u0153uvre d\u00e9pendra des textes d\u2019application attendus.
